Terms and conditions of use

Article 1 – Purpose

These Terms and Conditions of Use (hereinafter the “TCU”) govern access to and use of the LUNGTA mobile application, which allows users to order on-demand, immediate delivery services directly from their mobile device.

Use of the application implies full and unconditional acceptance of these TCU.

Article 2 – Scope of Application

These TCU apply to any use of:

 – the LUNGTA mobile application,

 – its functionalities,

 – and its associated services.

These TCU do not govern the commercial terms of the delivery services.
All matters relating to pricing, payment, insurance, returns and liability are governed by the General Terms and Conditions of Sale (GTC), which are available within the application.

Article 3 – No User Account Creation

Version V1 of the LUNGTA application does not require the creation of a user account.

Each order is placed directly within the application based on the information provided by the user for that specific use.

The user undertakes to provide accurate information, including in particular:

 – the collection address,

 – the delivery address,

 – access instructions,

 – a reachable telephone number.

LUNGTA shall not be held liable for delays, errors or delivery failures resulting from inaccurate or incomplete information.

Article 4 – Use of the Application

The user undertakes to use the application in compliance with:

 – applicable laws and regulations,

 – these TCU,

 – security rules,

 – fair and non-fraudulent use.

The following are strictly prohibited:

 – requesting the transport of prohibited, illegal, dangerous or restricted items;

 – abusive, improper or fraudulent use of the application;

 – any attempt at unauthorized access to LUNGTA’s systems.

Any abusive use may result in temporary or permanent suspension of access to the application.

Article 5 – Operation, Availability and Technical Limitations

LUNGTA makes every effort to ensure:

 – the availability of the application,

 – service quality,

 – continuity of essential functionalities.

However, the user acknowledges that the service may be temporarily unavailable due to:

 – maintenance operations,

 – updates,

 – technical incidents,

 – network congestion,

 – force majeure events (strikes, outages, weather conditions, etc.),

 – failures related to the user’s device or internet service provider.

LUNGTA shall not be held liable for interruptions or limitations resulting from such circumstances.

Article 7 – Push Notifications and Transactional Communications

1. Push notifications necessary for service operation

The application sends push notifications strictly related to the proper execution of the delivery service, including in particular:

 – order confirmation and payment-related updates (e.g. invoice availability),

 – courier en route to collection/delivery,

 – courier arrival at the collection location,

 – courier departure to the delivery location,

 – real-time delivery tracking,

 – confirmation of collection/delivery,

 – delivery confirmation,

 – immediate availability of the invoice,

 – and other similar functional messages.

Disabling push notifications may affect certain features, particularly real-time tracking.

LUNGTA will never send push notifications containing marketing or promotional content without the user’s explicit consent.

2. Transactional emails

LUNGTA sends only transactional emails strictly necessary for the performance of the service, including:

 – order/collection/delivery confirmations,

 – collection confirmation,

 – delivery confirmation,

 – invoice automatically sent after payment,

 – essential communications required for service execution.

These emails do not constitute marketing communications.

3. Invoice available for download in the application

After payment, the user may:

 – immediately download the invoice within the application,

 – and automatically receive it by email as a PDF attachment.

The invoice remains accessible as long as the user has not uninstalled the application or deleted the associated local data. It also remains accessible via the received email and is deleted only by the user’s own action (e.g. deletion of the email).

Article 8 – Intellectual Property

All elements contained in the application are protected by French and international intellectual property laws, including in particular:

 – interface,

 – design,

 – textual content,

 – logos,

 – architecture,

 – images,

 – functionalities,

 – source code.

Any reproduction, extraction or copying, even in part, is strictly prohibited without LUNGTA’s prior written authorization.

Article 9 – Security and User Responsibilities

The user is responsible for:

 – the security of their mobile device,

 – access to the application,

 – the accuracy of the information provided,

 – the contents of the parcel handed over to the courier,

 – compliance with transport rules (prohibited items, valuables, documents, etc.).

Any fraudulent use or breach of these TCU may result in restricted access or suspension.

Article 10 – Personal Data

Use of the application involves the processing of personal data.
Such processing complies with the GDPR.

The Privacy Policy is accessible within the application in the dedicated section.

Article 11 – Relationship with the GTC

These TCU govern access to and use of the mobile application.

All commercial and contractual aspects of the delivery service (pricing, payment, insurance, delivery terms, liability, etc.) are defined in the GTC, which shall prevail in the event of any conflict.

Article 12 – Liability

LUNGTA shall not be held liable for:

 – improper use of the application,

 – inaccurate information provided by the user,

 – temporary unavailability of the application,

 – technical or network failures,

 – force majeure events.

Article 13 – Amendments to the TCU

LUNGTA reserves the right to amend these TCU at any time.

The applicable version is the one available within the application at the time of use.

Article 14 – Governing Law and Jurisdiction

These TCU are governed by French law.

In the event of a dispute, the courts of Paris shall have exclusive jurisdiction.
